1. About these Terms
These Website Terms of Use (“Terms”) govern access to and use of the corporate website at thynkrsystems.com and its pages (the “Website”).
THYNKR SYSTEMS LTD is a company registered in England and Wales under company number 15306717, with its registered office at Office 2, 1st Floor, 73 Station Passage, London E18 1JL (“THYNKR”, “we”, “us” or “our”). Thynkr Systems is the name under which THYNKR trades.
By using the Website, you agree to use it lawfully and responsibly and in accordance with these Terms. If you do not agree, please do not use the Website.
These Terms do not exclude any mandatory rights that cannot lawfully be excluded.
2. What the Website is, and is not
The Website provides general corporate information about THYNKR, its products and its services. It is not professional, legal, financial or regulatory advice.
Using the Website, sending an enquiry or receiving a reply does not create a client relationship. Client engagements are governed by the Client Services Terms and a signed Statement of Work.
Products named on the Website are governed by each product’s own terms, linked from the legal hub.
3. Permitted use
You may view and link to public pages of the Website for lawful purposes. You must not:
- attempt to disrupt the Website or the systems that host it;
- gain or attempt to gain unauthorised access to any part of the Website, server or connected system;
- introduce malware or other malicious material;
- probe, scan or test the Website for vulnerabilities without THYNKR’s prior written authorisation;
- scrape or systematically extract content, or use automated requests in a way that impairs the Website;
- misrepresent Website content or imply an endorsement by THYNKR that does not exist; or
- use the Website in breach of the Acceptable Use Policy.
4. Accuracy and availability
We take reasonable care with published information, but it may change and may not be complete for a particular purpose. Product availability may differ by region, module and device; each product’s own website is the authoritative source for its current availability.
We aim to keep the Website available but do not guarantee uninterrupted or error-free operation. The Website may be unavailable because of planned or emergency maintenance, internet, cloud or telecommunications failures, provider outages, cyber incidents or circumstances beyond our reasonable control.
5. Intellectual property
Unless stated otherwise, Website content and the Thynkr Systems name, marks and presentation are owned by or licensed to THYNKR. Product names and marks belong to THYNKR or to the relevant partner.
You must not copy, modify or reuse Website content beyond what is reasonably needed to view, share or link to a page, except where applicable law expressly permits.
The Inter typeface used on the Website is licensed under the SIL Open Font License 1.1.
6. Links to other websites
The Website links to product websites operated by THYNKR and to third-party websites, including the website of our technology partner. Third-party websites are outside THYNKR’s control and are governed by their own terms and privacy information.
THYNKR is not responsible for the content or availability of third-party websites, except to the extent liability cannot lawfully be excluded.
7. Enquiries
If you send an enquiry through the contact form or by email, please do not include passwords, credentials or unrelated sensitive information. How we handle enquiries is described in the Privacy Policy.
8. Privacy and cookies
Our Privacy Policy explains how we handle personal information. Our Cookie Policy records what the Website stores on your device.
9. Liability
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that applicable law prohibits from being excluded.
Subject to that:
- THYNKR is not liable for indirect or consequential loss;
- THYNKR is not liable for loss of profit, revenue, anticipated savings, goodwill or business opportunity arising from use of, or inability to use, the Website, except where such exclusion is prohibited by law;
- THYNKR is not liable for the content of third-party websites linked from the Website; and
- because the Website is provided free of charge, THYNKR’s aggregate liability arising out of or relating to use of the Website will not exceed £100, except where such limitation is prohibited by law.
These limitations apply to the maximum extent permitted by law.
10. Changes to these Terms
We may update these Terms for legal, security, operational or content reasons. The version number and “Last updated” date at the top of this page identify the current version. Changes do not retroactively remove accrued rights or liabilities.
11. Third-party rights
A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce them.
12. Severability and waiver
If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder remains effective.
Failure to enforce a provision is not a waiver of that provision or any other provision.
13. Governing law and courts
These Terms and any non-contractual obligations arising from them are governed by the laws of England and Wales.
Subject to any mandatory law that applies, the courts of England and Wales have exclusive jurisdiction.
